Legal agreement governing the use of Chem Wizards website and purchase of research chemicals.
1. Acceptance of Terms
By accessing the website https://chemwizards.ca/ (the "Site") or placing an order with Chem Wizards ("we," "us," "our"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to all of these Terms, you may not use the Site or purchase any products. These Terms apply to all visitors, users, and researchers who access the Site.
We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site after any changes constitutes acceptance of the new Terms. The "Last updated" date at the top indicates when revisions were made.
2. Products for Research Purposes Only
All products sold by Chem Wizards are intended solely for in-vitro laboratory research and scientific analysis. They are not for human consumption, veterinary use, or any form of human or animal ingestion. No products are approved by the FDA, Health Canada, or any other health authority for therapeutic, diagnostic, or recreational use.
By purchasing from Chem Wizards, you explicitly acknowledge and agree that:
- You will use all products strictly for legitimate research purposes in a controlled laboratory environment.
- You will not misuse, ingest, inject, smoke, or otherwise introduce any product into a living organism.
- You assume full responsibility for complying with all applicable local, state, provincial, and federal laws regarding the possession, handling, and research use of chemical compounds.
3. Age Restriction (21+)
Our products are only available to individuals who are 21 years of age or older. By placing an order, you certify that you are at least 21 years old. We reserve the right to request age verification documentation (e.g., government-issued ID) before processing any order. If we discover that a user is under 21, we will cancel the order and delete associated personal data.
4. Product Information & Purity Claims
We advertise all products as >98% pure based on batch-specific HPLC or GC-MS analysis. While we strive for accuracy, slight variations may occur between batches. Certificates of Analysis (CoA) are available upon request for qualified researchers. Product descriptions, images, and specifications are for informational purposes only and do not constitute a warranty of fitness for a particular research application.
Chem Wizards does not guarantee that any specific research outcome will be achieved using our products. Researchers are responsible for validating product suitability for their own experimental protocols.
5. Ordering & Payment
After placing an order on the Site, you will receive an order confirmation email containing payment instructions based on your selected method (Interac e-Transfer, cryptocurrency, Apple Pay, Zelle, Cash App, bank transfer, Revolut). Orders are not binding until payment is confirmed by our team. We reserve the right to refuse or cancel any order at our discretion (e.g., suspected fraud, inability to verify age, or shipping restrictions).
Once payment is verified, your order is dispatched immediately. Prices are subject to change without notice. All prices are listed in CAD, USD, or EUR depending on your region; currency conversion fees (if any) are the buyer's responsibility.
6. Shipping & Delivery
All orders are shipped from Canada, the USA, or Europe. We offer:
- Express Shipping: 1–2 business days
- Standard Shipping: 3–5 business days
Delivery times are estimates and not guaranteed. We are not liable for delays caused by customs, weather, carrier disruptions, or incorrect shipping addresses provided by the customer. Title and risk of loss pass to you upon delivery to the carrier. However, we maintain a 98% successful delivery rate and offer a non-delivery guarantee (see Section 8).
We ship to PO Boxes and hotels. For hotel deliveries, please include the guest name and reservation number. Discreet packaging is used for all orders (plain boxes, no logos).
7. Cancellation & Returns
Cancellations: Orders may be canceled before dispatch by contacting Support@chemwizards.ca. Once shipped, cancellations are not possible.
Returns: Due to the nature of research chemicals, we do not accept returns for change of mind. If products arrive damaged or incorrect, please refer to Section 8 below. All sales are final after shipment except as provided in our refund policy.
8. Refund & Guarantee Policy
8.1 Non-Delivery Guarantee
If your order is not delivered (tracking shows lost or never delivered), you are entitled to a 100% money-back refund or one free re-shipment. Contact support immediately.
8.2 Damaged or Incorrect Products
Notify us within 48 hours of receipt with photos. We will provide a replacement or refund based on the situation.
8.3 Partial Refunds
Partial refunds may be issued for missing items, damaged products, or order discrepancies. Each case is reviewed individually.
8.4 How to Claim
Email Support@chemwizards.ca with your order number and evidence. Refunds are processed within 5–7 business days via the original payment method.
9. Prohibited Conduct
By using our Site and purchasing our products, you agree NOT to:
- Use any product for human or animal consumption.
- Resell, redistribute, or repackage our products without explicit written permission.
- Provide false or misleading information during checkout or age verification.
- Attempt to reverse-engineer, decompile, or tamper with our website's security features.
- Use our products for any illegal activity under local, federal, or international law.
Violation of these prohibitions may result in a permanent ban from our Site and legal action where applicable.
10. Disclaimer of Warranties
Chem Wizards provides products "as is" and "as available" for research purposes. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular research purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses.
No information, whether oral or written, obtained from Chem Wizards or through the Site shall create any warranty not expressly stated in these Terms.
11. Limitation of Liability
To the maximum extent permitted by law, Chem Wizards, its owners, employees, or affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of our products, inability to use the Site, or any breach of these Terms. This includes, without limitation, damage to research equipment, loss of data, or personal injury resulting from product misuse.
Our total liability for any claim arising out of or relating to these Terms or our products shall not exceed the amount you paid for the specific order giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Chem Wizards, its directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your violation of these Terms; (b) your misuse of any product; (c) your violation of any applicable law or regulation; or (d) your breach of representations regarding research purpose and age.
13. Intellectual Property
All content on the Chem Wizards website, including text, graphics, logos, product images, and the "Chem Wizards" name, is our exclusive property or used under license. You may not reproduce, distribute, modify, or create derivative works without our prior written consent. The logo and brand assets are protected by trademark laws.
14. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Canada (Province of Ontario), without regard to conflict of law principles. Any dispute arising from or relating to these Terms or your purchase shall be resolved through binding arbitration in Toronto, Ontario, unless otherwise agreed in writing. Each party shall bear its own arbitration costs. You waive any right to participate in a class action lawsuit against Chem Wizards.
For small claims or intellectual property disputes, either party may seek relief in competent courts of Ontario.
15. Severability & Entire Agreement
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between you and Chem Wizards regarding the use of our Site and purchase of products, superseding any prior agreements or communications.
